SWEEPSTAKES OVERVIEW/HOW TO ENTER:
You may enter the Zappos Face Game Sweepstakes (herein “Sweepstakes”) by first going to www.youtube.com (“Web Site”) and following the on-screen instructions for registering with YouTube™. In order to enter you must subscribe to the Zappos.com YouTube™ Channel located at www.youtube.com/zappos. Participation in this Sweepstakes is subject to, and all entrants must comply with, all policies, terms and conditions imposed by YouTube™, as well as those set forth in these Official Rules. All registration/subscription information must be completed in full. Once you have registered, click on the “Zappos Face Game” Video (the “Video”) and follow the instructions for taking the “Face Game” quiz. Email your answers to the email address provided in the Video, along with your name, mailing address, daytime telephone number and date of birth. Correct entries will receive two (2) entries to the Sweepstakes. Incorrect entries will receive one (1) entry to the Sweepstakes. To enter the Sweepstakes without taking the Face Game quiz, email your name, mailing address, daytime telephone number and date of birth to mmanson@zappos.com. Entrants who enter without taking the Face Game quiz will receive one (1) entry to the Sweepstakes. Entering more than once is prohibited and does not increase your chances of winning. Sponsor will not acknowledge receipt of such required information. Proof of submission does not constitute proof of receipt.
ELIGIBILITY: This Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia who were eighteen (18) years of age or older as of April 23, 2009. Employees of Sponsor, its affiliates, subsidiaries, distributors, sales representatives, advertising and promotion agencies, and all other service agencies involved with the design, execution or fulfillment of this Sweepstakes, and members of the immediate families (defined for these purposes as including spouse, parents, step-parents, children, step-children, siblings, step-siblings, and each of their respective spouses) or households (whether related or not) of any of the above are NOT eligible to participate.
DRAWING: Entry into the Sweepstakes begins at 12:00:01 a.m. Pacific Time (“PT”) on April 23, 2009 and ends at 11:59:59 p.m. PT on May 7, 2009 (the “Sweepstakes Period”). Any entries received after the Sweepstakes Period will not be considered. The potential winner will be selected in a random drawing from all eligible entries, which will be conducted on or about May 11, 2009. Entrants need not be present to win. Sponsor will notify the potential winner at a time that is commercially reasonable thereafter at the contact information provided at time of entry. Entrants odds of winning depend on the number of eligible entries received. If a dispute arises over entitlement to a prize, the winner is the person to whom the email account was assigned by the appropriate agency, internet service provider, business or organization. The winner may be requested to provide a valid, government-issued form of identification that matches the name under which the winner entered. If any prize, prize notification or Sweepstakes-related communication is lost, rejected, faulty, or returned as undeliverable or if a winner cannot be reached after a reasonable attempt has been made by Sponsor (as determined by Sponsor in its sole discretion), that winner will be disqualified and an alternate potential winner will be randomly selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate potential winner may be selected. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.
PRIZES: Five (5) First Prizes will be awarded, consisting of a Zappos backpack. Approximate retail value of each first prize in this Sweepstakes: $35.00. No cash redemptions or other prize substitutions permitted except by Sponsor, who may substitute a prize of equal or greater value if an advertised prize becomes unavailable. All prizes will be awarded provided they are properly claimed in accordance with these Official Rules and a sufficient number of eligible entries is received. Limit one prize per household. Each winner agrees to accept the prize “as is”, and entrants hereby acknowledge that Sponsor has neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize, including, without limitation, to the prize’s quality, merchantability or fitness for a particular purpose or express warranties (if any) provided exclusively by a prize supplier that are sent along with the prize. Sponsor will not replace any lost or stolen prizes.
GENERAL TERMS & CONDITIONS: The potential winners will be notified by email. A potential winner must confirm acceptance of the prize within five (5) days of receipt of initial notification or prize may be forfeited and an alternate potential winner may be selected from all eligible entries. If prize notification or any prize is returned as undeliverable, the corresponding potential winner will be disqualified and his/her prize will be forfeited, and an alternate winner may be selected from all eligible entries.
By entering this Sweepstakes, all entrants agree that neither Sponsor, nor its affiliated or subsidiary companies, advertising and promotion agencies, nor their respective shareholders, directors, officers, employees or agencies will have any liability whatsoever for any injuries, losses or damages of any kind caused by or in connection with any prize or resulting from participation in this Sweepstakes or from acceptance, possession or use of any prize or participation in any prize-related activity, or use by Sponsor of the entry in any manner. Acceptance of a prize will constitute and signify the winner’s agreement and consent to the Sponsor’s and/or the Sponsor’s assignees’ use of the winner’s name and/or prize information for promotional purposes in commerce and in all media worldwide now known or hereinafter developed without limitation and without notice or further compensation. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrant’s rights, and obligations, or the rights and obligations of the Sponsor in connection with this Sweepstakes, will be governed by, and construed in accordance with, the laws of the State of Nevada, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Sweepstakes, including without limitation barring entrants who do not comply with these Official Rules. By entering, entrants consent to the jurisdiction and venue of the federal, state, and local courts located in Nevada. Except where prohibited, as a condition of participating in this Sweepstakes, each entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, the prizes awarded, or the determination of the winners shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will an entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses, and entrant further waives all rights to have damages multiplied or increased.
